By creating an account or using the Outsome platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Service description

Outsome is an AI-powered reputation management platform that helps businesses:

• Collect customer feedback via WhatsApp, QR codes, and direct links.
• Automatically generate and publish AI-written replies to Google, Facebook, and Instagram reviews.
• Manage social media comments on connected Meta pages and Instagram accounts.
• Send WhatsApp messages for order confirmations, delivery notifications, and feedback requests.
• Analyse review sentiment and track reputation metrics.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Outsome is offered under a monthly subscription model. The following terms apply:

• Subscriptions are billed monthly in advance. Prices are listed in euros (€) and exclude VAT where applicable.
• A 14-day free trial is available to new accounts. No credit card is required during the trial.
• After the trial, continued access requires a paid subscription.
• Subscriptions automatically renew each month. You may cancel at any time; cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial months. If you upgrade your plan mid-cycle, the difference is prorated.
• We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

5. Intellectual property

The Outsome platform, including its design, code, and trademarks, is owned by Outsome and protected by intellectual property law. You retain ownership of your business data and content. By using the Service, you grant us a limited licence to process your content solely to provide the Service. AI-generated replies are produced on your behalf and you are responsible for them.

6. Limitation of liability

To the fullest extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
• We are not responsible for AI-generated content that you publish on third-party platforms.
• Our total liability for any claim arising from your use of the Service is limited to the fees you paid in the 3 months preceding the claim.
• We are not liable for interruptions caused by third-party platform outages (Google, Meta, WhatsApp).

7. Termination

We reserve the right to suspend or terminate your account without notice if you violate these terms, engage in fraudulent activity, or cause harm to the Service or other users. Upon termination, your access ceases immediately and your data is deleted in accordance with our Privacy Policy.

8. Governing law

These Terms are governed by the laws of Romania. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Romania. If you are a consumer in the EU, you may also have rights under the law of your country of residence.
